VA Costs Are a Business Deduction — But Documentation Matters
The good news for business owners is that virtual assistant costs are fully deductible as ordinary and necessary business expenses under IRC Section 162. International VA Tax Considerations
No 1099 for Foreign Contractors
If your VA is based outside the United States and performs services entirely outside the US, you generally do not need to file a 1099-NEC. Instead, have the VA complete IRS Form W-8BEN (for individuals) or W-8BEN-E (for entities) confirming their foreign status. Retain these forms in your records.
US withholding taxes generally do not apply to independent contractor payments for services performed entirely abroad. However, if the services are performed within the US (including by a foreign VA temporarily present in the US), different rules apply.
Currency and Payment Method Records
Payments made in foreign currency require additional recordkeeping. Document the exchange rate used, the transaction date, and the USD equivalent of each payment. Most payment platforms — Wise, PayPal, Payoneer — generate records that capture this information automatically. Export and retain these records with your tax files.
Sales Tax and VAT
Some countries impose VAT on services provided to foreign businesses. If your VA issues invoices with a VAT component, understand whether your business has any obligation with respect to that VAT. In most cases for US-based businesses receiving services from foreign contractors, the VAT is the contractor's responsibility — but verify with your accountant.
Recordkeeping Best Practices
Maintain the following for each VA relationship: the signed contractor agreement, all W-9 or W-8 forms, all invoices received, all payment records with dates and amounts, and any documentation of service scope changes. Retain these records for a minimum of seven years — the IRS statute of limitations for audits involving fraud has no limit, and the standard limitation period for income-related issues is three to six years.
